1.1 These Terms and Conditions (Terms) govern the access and use by the Customer and Student of all applications, websites, products, services, content and the Uniworker Platform made available by Uniworker Pty Ltd ACN 662 104 216 (Uniworker).
1.2 These Terms apply between the Customer, Student and Uniworker and upon a User accessing the Uniworker Platform and/or using the Uniworker Platform is deemed to be bound by these Terms which establish a contractual relationship between the User and Uniworker and between the Users who engage in a Service Contract.
1.3 These Terms replace any existing terms between the Parties and apply to all agreements (including any existing arrangements at the date of this agreement) for the supply of Services by the Student. These Terms will continue .to apply and will prevail any agreement separately entered between the Customer and the Student.
1.4 These Terms are binding on the User with respect of all access to and/or using the Uniworker Platform, including the Student providing the Services. If a User does not agree to any of the Terms then such User is not permitied to use the Uniworker Platform.
1.5 If there are any inconsistencies between these Terms and any other agreement or writien or verbal agreement between the Customer and the Student, these Terms prevail.
1.6 Uniworker may vary these Terms from time to time without the requirement to provide notice to a User. A Users continued access and/or use to the Uniworker Platform constitutes consent to be bound by the amended Terms. A Service Contract entered into before the variation will be governed by the Terms in place as at the date that the Service contract was entered into. If an unaccepted Service Request is accepted atier the date that the Terms are varied the Service Request when accepted will be governed by the varied Terms.
1.7 All defined terms in these Term s have the meaning given to them in the definitions outlined in clause 27.
2.1 Every Customer and Student acknowledge that Uniworker does not provide the Services, but provides the Uniworker Platform which allows Customers to publish Service Requests on the Uniworker Platform.
2.2 Uniworker operates an online Platform allowing Users to connect through the Uniworker Platform with other Users who provide Services.
2.3 The Terms outline Uniworker's and the User's obligations and responsibilities by using the Uniworker Platform.
3.1 Uniworker does not provide the Services to the Users directly but provides the Uniworker Platform which allows Customers to publish Service Requests on the Uniworker Platform.
3.2 A Customer must specify what the Service Request entails including whether any specific desired skills or licensing requirements are required for a Student to accept the Service Request.
3.3 Every Service Request must specify an Agreed Value which the Student who accepts the Service Request will be paid upon completion of the Services. The Student and the Customer understand and acknowledge that the Student will be paid the Agreed Value on completion of the Service Contract (less the Uniworker Student Fee).
3.4 If the Services are a Recurring Service, the Customer must specify the Agreed Value is for the Recurring Services, and the calculation of fees to be paid to the Student per Occurrence.
3.5 A Customer acknowledges that any User who has access to Uniworker is able to access and see their Service Request.
3.6 A Customer may amend, modify or delete a Service Request at any time and as many times as desired provided a Student has not yet accepted the Service Request.
3.7 A Student may elect to accept any unaccepted Service Request at any time, provided the Student has reasonable belief that they can carry out such Service Request appropriately and to a satisfactory standard in accordance with the Service Request terms and requirements.
3.8 A Student may make a counterproposal in response to a Service Request. A Customer may elect to accept any such counterproposal in which case a Service Contract has been created between that Student and Customer.
3.9 If a Student has accepted a Service Request, a Service Contract is created between the Student and the Customer of that Service Request.
3.10 If a Customer accepts the counterproposal to a Service Request, a Service Contract is created between the Student and the Customer of that counter proposed Service Request.
3.11 The Customer acknowledges that the Uniworker Customer Fee will be a payment obligation in addition to the payment obligation of the Agreed Value.
4.1 The Uniworker Customer Fee is payable to Uniworker in respect of a Service Contract.
4.2 Once a student has accepted a Service Request or once a Customer has accepted a counter proposed Service Request, a Service Contract is created between the Student and the Customer for that Service Request.
4.3 Once a Service Contract is created, the Customer:
4.4 When the Agreed Value (less the Uniworker Student Fee) is released to the Student, the Uniworker Customer Fee will be retained by Uniworker.
5.1 The Uniworker Student Fee is payable to Uniworker in respect of a Service Contract.
5.2 Once a student has accepted a Service Request or once a Customer has accepted a counter proposal Service Request, a Service Contract is created between the Student and the Customer for that Service Request.
5.3 Once a Service Contract is created the Student acknowledges that Uniworker has provided its services and the Uniworker Student Fee is due and payable to Uniworker.
5.4 When the Agreed Value (less the Uniworker Student Fee) is released to the Student, the Uniworker Student Fee is released from the Agreed Value and retained by Uniworker.
5.5 The Student acknowledges that all Fees and charges payable to Uniworker include GST and are non- cancellable and non-refundable.
6.1 Once a Service Contract has been created between a Student and a Customer:
6.2 For the avoidance of any doubt, the Services cannot commence until the Customer has made payment of the Agreed Value and the Uniworker Customer Fee into the Uniworker Account. Upon payment of the Agreed Value and the Uniworker Customer Fee into the Uniworker Account, the Student will be notified that the Services may be undertaken.
6.3 Subject to clause 6.4 below, once the Services have been completed by the Student:
6.4 If the Services are a Recurring Service in accordance with clause 9, then:
7.1 Uniworker may restrict any User from accessing or using the Uniworker Platform in whole or part, at any time and effective immediately without providing any notice to such User in circumstances where Uniworker, at their sole discretion, suspects that:
7.2 Uniworker may also cease offering or deny access to a User to the Uniworker Platform (by restricting or deactivating access to the Uniworker Platform, including banning a User's email address and mobile number from signing up again to the Uniworker Platform):
7.3 A User may stop using the Uniworker Platform at any time for any reason, provided any accepted Service Request has been completed. If a Service Request has been accepted and a Service Contract formed the User will be subject to the Terms until the Service Contract is completed.
8.1 If a Student Applicant wishes to accept Service Requests on the Uniworker Platform, they must submit a Student Application meeting the Student Requirements.
8.2 A Student Applicant must create an account on the Uniworker Platform and upload their Student Application through the Uniworker Platform.
8.3 A Student Applicant must only apply to be a Student for the purposes of a Uniworker Platform if they consider themselves to meet and satisfy, in full, the Student Requirements.
8.4 Uniworker may, in their sole discretion, approve, deny or require further evidence and information of a Student Application.
8.5 If a Student Application:
8.6 A Student Applicant has no right or claim against Uniworker for denying a Student Application.
8.7 Once a Student Applicant has been approved as a Student by Uniworker, that Student may accept Service Requests on the Uniworker Platform. Such Student agrees that it will not accept any Service Requests on behalf of another person and any accepted Service Request will be carried out by the Student of the Student Application.
8.8 Despite anything these Terms say, the Student acknowledges that having their Student Application approved by Uniworker does not entitle or guarantee such Student any Service Contract (thereby the Agreed Value for completing such Service Contract).
8.9 Once a Student Applicant is approved as a Student, if for any atier such time that Student no longer maintains meeting the Student Requirements, then their Student Application will be denied. For the avoidance of doubt, Uniworker may deny a Student Application at any time despite already been approved. Uniworker are not required to give reasoning as to how the Student has failed to meet the Student Requirements.
8.10 A Student must inform Uniworker if they no longer meet the Student Requirements. A Student also acknowledges and confirms that they will cease using the Uniworker Platform as a Student if they no longer meet the Student Requirements and Uniworker is not liable for a Student's failure to cease using the Uniworker Platform upon such knowledge that they fail to meet the Student Requirements.
9.1 If a Customer intends for the Services to be Recurring Services, then the Customer must list such Service Request as Recurring Services.
9.2 The Student must accept the Recurring Services in its entirety and not a portion of the Recurring Services. A Student understands and acknowledges that upon accepting a Recurring Services Service Request that they agree to complete the entirety of the Recurring Services.
9.3 Once a Student has accepted a Service Request that relates to Recurring Services, clause 6 applies.
9.4 Each time a Student completes an Occurrence of the Services, then the Customer must confirm the Occurrence has been completed (or alternatively if Uniworker are satisfied that an Occurrence has been completed). If this occurs, and Uniworker is satisfied that an Occurrence has been completed, then Uniworker has full discretion to confirm an Occurrence (or Service Request) has been completed.
10.1 Uniworker only provides the Uniworker Platform, which allows Customers to publish Service Requests, and Students to accept and receive payment for completing the Services for that Service Request.
10.2 Uniworker only allows individuals over the age of eighteen (18) to become Users.
10.3 A User must be a natural person, however a Customer may specify in their Service Request that they represent a business entity.
10.4 Uniworker has complete discretion to cancel or refuse any person who registers or creates an account with Uniworker for any reason. Noting that a Student must meet the strict Student Requirements to register and accept Service Requests as a Student in accordance with clause 8.
10.5 A User registering and creating an account on the Uniworker Platform is free of charge. There are no fees payable for a Customer to post a Service Request on the Uniworker Platform, only if the Service Request is accepted in which case the Uniworker Customer Fee and the Uniworker Service Fee is payable.
10.6 Uniworker is not liable for any aspect of the Customer and Student interaction. This includes an accurate description of the Services, the performance of the Services and the actual completion of the Services.
10.7 Uniworker takes absolutely no responsibility and make no warranty as to the accuracy of any information provided by any Users, including (but not limited to), a Students ability to complete or perform the Services, whether a Student has mislead their Student Requirements satisfaction, the Customers ability to pay for the Services or anything else.
10.8 The Uniworker Platform is provided on an as is where is basis and Uniworker makes no representation or warranty as to the condition of the Uniworker Platform and the conditions for use by a User, whether express or implied.
10.9 Uniworker has no responsibility or obligation to any User to assist, involve, guide or manage the contractual relationship and Services between a Customer and Student, including resolving or assisting in any disputes between the Users.
10.10 All Users acknowledge and agree that Uniworker bears no responsibility as to the suitability of any Students in performing the Services. Uniworker does not undertake any investigations or reviews of any Users before gaining entry to the Uniworker Platform, which includes any criminal checks, any verifications of qualifications or licenses, whether the Student continues to meets the Student Requirements, suitability or background checks to perform any Services.
10.11 The Customer acknowledges and agrees that the Customer is solely liable for the Services to be completed in a manner and expectation satisfactory to the Customer and assume all risks for any loss, liability, injury, death, damage and costs arising from, whether directly or indirectly, from the Services including any consequential loss.
10.12 The Customer and Student release, indemnify and hold harmless Uniworker from all responsibility, liability and risk from any loss, liability, injury, death, damage or costs arising from, whether directly or indirectly, anything to do with the Services including any consequential loss.
11.1 All Customers and Students acknowledge and agree that:
11.2 The Customer must specify if the Student requires any specific equipment, tools or otherwise to carry out the tasks. The Customer must also specify if the specific equipment, tools or otherwise must be provided by the Student or if the Customer will supply such items. If the Customer requests the Student to have specific tools then the Student agrees that they will only accept the Services on the basis that they possess (or will possess) the required tools. Failure for the Student to possess the required tools to complete the Services will render the Student at fault and the task may be cancelled by the Customer.
11.3 Unless specified in the Service Request, the Student will not be liable or able to claim for any reimbursement of fees incurred when carrying out the Service Request.
11.4 A Student agrees that they will not subcontract any part of the performance of the Services to a third party, unless the Customer and Student mutually agree otherwise. Despite this, any Services subcontracted must be completed by another Student registered through the Uniworker Platform and cannot be completed by an individual who does not meet the Student Requirements.
11.5 Uniworker reserve the right to remove any content, Service Requests or otherwise on the Uniworker Platform, suspend or cancel any accounts or Service Contracts if they reasonably believe any obligation or term has been breached under the Terms.
12.1 Customers and Students acknowledge that the Uniworker Customer Fee and the Uniworker Student Fee is payable on every Service Contract. The Customer must factor into account when posting the Agreed Value that they also have an obligation to pay the Uniworker Customer Fee and the Student acknowledges that upon completion of the Service Contract that they are entitled to the Agreed Value less the Uniworker Student Fee.
12.2 Subject to clause 13, all fees, charges and the Agreed Value are non-cancellable and non-refundable.
12.3 The Uniworker Customer Fee and the Uniworker Student Fee includes GST.
12.4 Uniworker reserve the right to amend the Uniworker Customer Fee and the Uniworker Student Fee from time to time. If this applies, Uniworker will send a notification to each User that the terms have been updated. If a User accesses and uses the Uniworker Platform atier the terms have been updated then they actively agree to the amended terms. Any Service Request that is posted but not yet accepted will be subject to the new Uniworker Customer Fee and the new Uniworker Student Fee.
12.5 A Service Contract entered into before the amendment to the Uniworker Customer Fee and the Uniworker Student Fee will be governed by the Terms in place as at the date that the Service Contract was entered into.
12.6 For the avoidance of doubt, the Customer and Student provide irrevocable authorisation for Uniworker to deduct the Uniworker Student Fee from the Agreed Value which has been paid to the Uniworker Account.
13.1 Subject to clause 13.4, if a Service Contract is cancelled by a Customer, Student or under these Terms, then:
13.2 For the avoidance of doubt, the Customer and Student provide irrevocable authorisation for Uniworker to deduct the Cancellation Fee from the Agreed Value which has been paid to the Uniworker Account.
13.3 If for any reason the Agreed Value was not paid into the Uniworker Account, then the Cancellation Fee becomes a debt due and owing by the Customer.
13.4 Despite anything these terms says, if the Service Contract is cancelled by the Student and the Services have not commenced in any way then the Cancellation Fee is payable by the Student and not the Customer.
13.5 A User may terminate a Service Contract if the other party to the Service Contract has been suspended from the Uniworker Platform, notified by Uniworker or as otherwise agreed pursuant to the dispute process of these Terms.
14.1 Uniworker uses Stripe to operate the Uniworker Account.
14.2 The Users acknowledge that the terms and conditions at htips://stripe.com/en-au/legal/ssa are incorporated into these Terms and will prevail if there are any inconsistencies in relation to the Uniworker Account only. In Users using the Uniworker Platform they agree to the terms and conditions specified in this clause.
15.1 In registering an account with the Uniworker Platform, each User consent for Uniworker to use, process and store all and any personal information uploaded in accordance with Uniworkers Privacy Policy. This includes providing such information to any third-party as required by legislation or for assessing personal data.
15.2 All Users must comply with Privacy laws and much ensure that any and all Confidential Information is kept confidential and is also dealt with in accordance with such Privacy Laws.
15.3 Users acknowledge that Uniworker cannot guarantee any Users identity to remain anonymous. Noting this, Uniworker is not liable for any fraud, identity theti or other behaviour, consequence or action that results from any information being uploaded to the Uniworker Platform. Uniworker reserves its rights to verify or reverify any User of which such User must comply with any requests.
16.1 A User may seek and obtain insurance for Service Contracts if desired. It is solely up to the User to organise such insurance. No User is required to obtain insurance if that User does not wish to obtain insurance for the Services.
16.2 Uniworker in no way represents that insurance will be offered for any Services posted on the Uniworker Platform, nor provide or advise on whether specific Services should require insurance.
16.3 Obligations for insurance are strictly on the individual User and each User must make its own enquiries as to whether insurance is required. If insurance is obtained, such third-party insurance provider must agree to these Terms.
16.4 Uniworker has complete discretion to take out its own insurance. Such insurance will not govern any Users and Users confirm that they are solely responsible for themselves and their actions with respect of any Services. Uniworker has complete discretion to change insurers or the terms of its insurance policies at any time.
17.1 Uniworker is not liable for any loss or damage, whether such loss or damage is actual, direct, indirect or consequential, of all kind and nature, whether known or unknown (disclosed or undisclosed), arising from or out of, in any way anything connected with any transaction, involvement, communication, engagement between a Customer and a Student. This includes any loss or damage of any kind (whether direct, indirect or consequential) relating to any information provided (that may or may not have been inaccurate), or a lack of suitability, skill, quality of Services or Student, including any Services provided for any reason.
17.2 Uniworker is not liable or responsible for any loss, damage, expense or consequential loss suffered by any User or third party arising in any way out of, or connected with Uniworker or the Uniworker Platform.
17.3 Uniworker is only liable to any User of the Uniworker Platform up to the total amount of the Agreed Value or $100.00, whatever is greater.
17.4 Uniworker is not liable for any resupplying, replacing, repairing or amending any goods or services from Services being provided, whether or not they are provided at an unsatisfactory standard or not, including whether or not a breach has occurred.
18.1 Uniworker may elect to modify, amend, alter, delete or replace these Terms at any time.
18.2 If Uniworker elects to rely on clause 18.1, Uniworker will send a notification to every User to their nominated email address that was used to create an account on the Uniworker Platform.
18.3 A User agrees to any updated terms by continuing to use the Uniworker Platform atier the Terms have been updated. If any User has any issue with the Terms or any updates, then the User should either terminate their account immediately or notify Uniworker immediately and in the interim cease using the Uniworker Platform.
19.1 These Terms do not create any agency, partnership, employee/employer contract, joint venture, conjunctional agent, contractor relationship between the Customer and Student, or any User and Uniworker.
20.1 A notice must be in writing and handed personally or sent by fax, email or prepaid mail to the User or Uniworker (through the contact us page). Notices sent by mail are deemed to be received 5 days atier posting.
20.2 Notices sent by fax or email are deemed received on confirmation of transmission.
21.1 This clause applies if any dispute arises between a Customer and Student, or a User and Uniworker.
21.2 In the first instance, Uniworker encourages Customers and Students to atiempt to resolve disputes between themselves directly. If a dispute arises between a Customer and Student, or between Users, the Users agree to co-operate with each other and use all reasonable and genuine atiempts to resolve the dispute amicably.
21.3 If a dispute arises between Users, then such Users acknowledge and agree that Uniworker may elect, in its absolute discretion, to provide each Users details that are in the dispute to the other party in the dispute.
21.4 Users must demonstrate that they have atiempted to resolve the dispute between each other before referring the dispute to Uniworker. If Uniworker considers this to not be completed, then Uniworker may instruct the parties to atiempt to resolve the dispute between the parties before Uniworker will consider assisting the dispute.
21.5 If a dispute is referred to Uniworker, Uniworker may elect to charge a Dispute Fee. This fee will be paid equally between the parties, or by one party if Uniworker elects so. This Dispute Fee will be issued to the party liable for payment and failure to make payment will become a debt due and owing to Uniworker.
21.6 Uniworker reserves the absolute right to make a final determination from the information provided by the Users in the dispute. The parties agree that this decision is final and binding on the parties. In this regard, it is highly encouraged for each User to provide as much details of the dispute to Uniworker to ensure Uniworker has an accurate understanding of the dispute from both parties. Uniworker is not liable for a parties failure to provide information of the dispute (or sufficient information) and cannot be held accountable if the decision made by Uniworker is due to this.
21.7 During the dispute, Uniworker has full discretion to hold any Agreed Value in the Uniworker Account until the dispute has been resolved. The parties agree for Uniworker to elect to deduct the Dispute Fee from the Agreed Value.
21.8 If a party has a complaint about the Uniworker determination of the dispute then such User must lodge such complaint directly with Uniworker.
21.9 Each User the party of a dispute agrees and consents to their information being provided to the other User in the dispute. Uniworker will not be liable for any costs, losses, liabilities, direct or indirect consequences in relation to any dispute or claim.
22.1 In these Terms, intellectual property means any form of intellectual property capable of being granted protection at law including, but not limited to registered and unregistered trade marks, patents, designs, trade secrets, drawings, reports, calculations and other deliverables.
22.2 Any intellectual owned by Uniworker prior to commencement of these Terms will remain the property of Uniworker and the User acknowledges that nothing in these Terms will be construed as transferring title in or ownership of any intellectual property to the User.
23.1 Subject to clause 23.2, a User may terminate or suspend their account on the Uniworker Platform at any time for any reason.
23.2 If a User has entered into a Service Contract then the User must ensure the Service Contract has been completed prior to terminating or suspending their account on the Uniworker Platform.
23.3 Uniworker will not be liable for a User's termination or suspension of an account if a Service Contract is in place.
23.4 If a Customer has an unaccepted Service Request posted on the Uniworker Platform and that Customer cancels, suspends, terminated (or Uniworker suspends or terminates) that Users account on the Uniworker Platform, then that unaccepted Service Request will be automatically deleted from the Uniworker Platform.
23.5 All of these Terms survive any termination, suspension or cancellation of any User's account on the Uniworker Platform.
23.6 If Uniworker terminates or suspends a User's account for any reason (in its absolute discretion without requiring any notice to be provided to that User) then any further account created by that same User may also be terminated or suspended.
24.1 Uniworkers failure to enforce any of these Terms will not be construed as a waiver of any of Uniworkers rights.
24.2 If any of these Terms are unenforceable, it will be read down to be enforceable or, if it cannot be read down, the term will be severed from these Terms without affecting the enforceability of the remaining Terms.
24.3 A notice must be in writing and handed personally or sent by fax, email or prepaid mail to the addressee. Notices sent by mail are deemed to be received 5 days atier posting.
24.4 Notices sent by fax or email are deemed received on confirmation of transmission.
24.5 The User acknowledges that no oral terms or representations form part of these Terms.
24.6 The law of Queensland from time to time governs these Terms.
24.7 To the extent of any discrepancy between these Terms and any third party (including the User's own) Terms, these Terms prevail.
24.8 These Terms constitute the entire agreement between the parties and no amendment or variation will be of any force and effect unless Uniworker elects, at its full discretion to do so.
24.9 Uniworker will not be liable for any loss or damage suffered by a User due to any delay or any breach or default under these Terms in circumstances where such delay, breach or default results from causes beyond Uniworker's control including but not limited to acts of God, fires, flood, adverse weather, strikes, lockouts, factory shutdowns or alterations, embargoes, wars, riots, delay or shortage in transportation.
24.10 Uniworker shall be under no liability whatsoever to the User for any indirect and/or consequential loss and/or expense (including loss of profit) suffered by the User arising out of a breach by another User of these terms and conditions.
24.11 Uniworker may license or sub-contract all or any part of its rights and obligations without the User's consent.
24.12 The failure by Uniworker to enforce any provision of these Terms shall not be treated as a waiver of that provision, nor shall it affect Uniworker's right to subsequently enforce that provision.
24.13 The provisions of these Terms are severable and if any provision or clause in these Terms are held to be unenforceable or invalid then such provision may be removed or deleted and the remaining terms and provisions will be enforceable on the parties.
24.14 These Terms set out the entire agreement between the User and Uniworker, and the Customer and Student.
25.1 A Student agrees and acknowledges that they must have the right to provide Services under a Service Contract and to work in the jurisdiction where the Services are performed. A Student must comply with tax and regulatory obligations in relation to any payment (including the Agreed Value) received under a Service Contract.
25.2 In using the Uniworker Platform, all User's acknowledge and agree that they take full responsibility in ensuring they comply with their tax obligations, including paying any direct or indirect taxes, including any GST or income tax, which may apply to them depending on residency, location or otherwise, under provisions of their jurisdiction.
25.3 All Users are highly encouraged to seek their own tax advice with respect of their personal tax requirements in using the Uniworker Platform (including seeking tax advice with whether they are required or need an ABN for the purposes of using the Uniworker Platform).
25.4 Uniworker is not liable for any User who fails to submit their tax return or business activity statement, including whether such is submitied incorrectly or results in any type of penalty, default, tax interest or otherwise as a result of using the Uniworker Platform.
25.5 The Student represent and warrant that they comply, and will comply at all times, with their obligations under income tax provisions in their jurisdiction. The Agreed Price is inclusive of all such taxes and charges that may apply to the Student.
25.6 The Student hereby appoints Uniworker as the Student's limited authorised payment collection agent solely for the purpose of accepting payments (via its payment services provider, if applicable) from Customers, and remiting those payments to the Student. The Student agrees that payment from a Customer to Uniworker shall be considered the same as made directly to the Student. The Customer's payment obligation to the Student will be satisfied upon receipt of payment by Uniworker (or its payment services provider, as applicable), and Uniworker (via its payment services provider, as applicable) is responsible for remiting the funds (less the Uniworker Student Fee) to the Student in the manner described in these Terms. In the event that Uniworker (via payment services provider) does not remit any such amounts to the Student, the Student will have recourse only against Uniworker and not the Customer directly.
25.7 Uniworker may be required by applicable laws to charge users with indirect taxes (such as GST) or to withhold taxes. Any amount Uniworker will be required to collect and any amount Uniworker will be required to withhold will be deducted from the Student's revenue, as required by applicable laws.
26.1 In these Terms, if any provision of these Terms is ambiguous, it is to be interpreted broadly to widen and not restrict the provisions, and, unless the context otherwise requires:
26.2 Each party acknowledges that it has read and understood this document and has had the opportunity to obtain independent financial and legal advice about its terms.
Agreed Value means the agreed value for Services
(including any variation) to be
completed by the Student, paid into
the Uniworker Account by the
Customer.
Approved Student means a Student Application which
satisfies the Student Requirements.
ACL means the Australian Consumer Law
Cancellation Fee means 25% of the Agreed Value.

Information
means these Terms and conditions.
Dispute means any dispute arising between
the Users.
Dispute Fee means 25% of the Agreed Value.
Occurrence means each individual occurrence of
services to be performed by the
Student that form part of the
Recurring Services.
Parties means Uniworker, the Student and the
Customer, or any two of them.
Customer means a User that uses the Uniworker
Platform to post a Service Request
which requires Services by a Student
in exchange for the Agreed Value.
Privacy Laws means the Privacy Act 1988 (Cth) and
any rules, regulations or principals
created, enacted or enforced pursuant
to that act.
Privacy Policy means the privacy policy of Uniworker
available on the Uniworker Platform
Recurring Service means the Services require multiple
services, attendances or are broken
down over a period to complete the
Services.
Service Contract means a contract which is formed
between a Customer and the Student
for the Services in exchange for the
Agreed Value. This Service Contract
includes all of these Terms and are
binding on the parties.
Service Request means an advertisement posted by
the Customer on the Uniworker
Platform (as varied by the Customer)
which requires the Services in
exchange for the Agreed Value.
Services means the services to be completed
by the Student who accepts the
Service Request, which include the
services required as described in the
Service Request advertisement and
include any variations or amendments
to the requires services that are
accepted in writing by both the
Customer and the Student.
Student means an individual who has
submitied a Student Application
through the Uniworker Website and is
deemed an Approved Student.
Student
Application
means the application submitied
through the Uniworker Platform by an
individual who intends to become a
Student.
Student Applicant means any individual that applies
through the Uniworker Platform to
become a Student.
Terms means these terms and conditions,
which includes any variations.

Account
means the account created to receive
payment from and make payments to
Users and Uniworker.
Uniworker

means www.uniworker.com
Uniworker
Customer Fee
means the fee, equal to $3.00 per
hour, payable by the Customer in
consideration for Uniworker proving
the Uniworker Platform
Uniworker Student
Fee
means the fee, equal to $1.00 per
hour, payable by the Student in
consideration for Uniworker proving
the Uniworker Platform which the
Student acknowledges is include as
part of the Agreed Value agreed
between the Customer and the
Student before the Service Contract is
entered into
User means every Customer and Student.
For the avoidance of any doubt, a
person may in some circumstances be
a Customer and a Student.
